Terms and Conditions

If you make a booking with TdM Beheer BV, the below terms and conditions apply.

EXCLUDING REVOCATION RIGHT

TdM Beheer BV. would like to point out that any bookings you make are legally final. No revocation right of 14 days (the so-called cooling-off period) applies to the agreements you enter with TdM Beheer BV

1. APPLICABILITY

1.1 These Terms and Conditions apply to all offers, bookings and agreements related to all accommodations and camping pitches, as well as other facilities rented out by TdM Beheer BV or its related enterprises ("TdM Beheer BV).
1.2 In these Terms and Conditions, the term 'tenant' refers to: the person entering into an agreement with TdM Beheer BV related to rental/use of an accommodation and/or camping pitch. The term "user" (hereafter also referred to as guest) refers to: the tenant and the persons registered by the tenant who use, or will be using, the accommodation and/or other facilities rented by the tenant.
1.3 These Terms and Conditions apply regardless of any of your own private conditions you may have referred to (in advance) or of any other terms and conditions. TdM Beheer BV rejects any Terms and Conditions you may refer to or use.
1.4 Any agreements deviating from these Terms and Conditions are only valid if they have been agreed upon in writing.

2. BOOKINGS

2.1 TdM Beheer BV only accepts bookings made by persons 18 years of age or older. Bookings made by persons younger than that age are not valid.
2.2 TdM Beheer BV reserves the right to refuse deviating bookings, in particular for groups, without the obligation to provide a reason, or to set special conditions such as a larger deposit to be paid in cash at the reception desk.
2.3 In case TdM Beheer BV accepts your booking, TdM Beheer BV will send you a written confirmation as well as an invoice within 14 days after making the booking. It is your responsibility to check it for accuracy immediately upon receiving it. Any inaccuracies must be reported to TdM Beheer BV immediately.
2.4 If you have not received a written confirmation/invoice within 14 days after making the booking, you must contact TdM Beheer BV without delay, with failure to do so causing you to lose the option of making any claims regarding your booking.
An agreement is created between you and TdM Beheer BV at the moment TdM Beheer BV confirms the booking for you.
2.6 The agreement concerns rental of the accommodations and/or camping pitch and/or other facilities for recreational use, which is short-term in nature.

3. CHANGES TO THE AGREEMENT

3.1 If, after the creation of the agreement, you would like to make changes to the agreement, TdM Beheer BV is not obligated to accept them. It is up to the discretion of TdM Beheer BV to determine whether and to what degree those changes are accepted. In case TdM Beheer BV accepts your changes, TdM Beheer BV may charge alteration costs to you.
3.2 Changes in arrival date and/or location within 28 days before arrival are not permitted. In these cases, the cancellation costs as defined in article 14. of these Terms and Conditions apply.
3.3 If, after creation of an agreement for more than one bungalow, you would like to decrease the number of bungalows, the cancellation conditions as defined in article 14. of our Terms and Conditions apply.

4. SUBSTITUTION

4.1 The tenant and other users are not allowed to allow use of the accommodation and/or camping pitch under any designation or on any basis to anyone but the persons named in the agreement, unless otherwise agreed upon in writing with TdM Beheer BV.
4.2 If you and TdM Beheer BV have agreed that you and/or one or more users will be replaced, you – in addition to the tenant and/or users replacing you and/or other users – will remain severally liable to TdM Beheer BV for the payment of the portion of the rental sum still to be paid, the alteration costs (see article 3.1) and any extra costs resulting from the replacement and any cancellation costs.

5.5 PRICES

5.1 You owe TdM Beheer BV the agreed upon rental price as noted in the booking's written confirmation and invoice.
5.2 No use of price discounts and/or special offers can be made once the confirmation of the booking/invoice has been sent by TdM Beheer BV.
All prices, insofar as is applicable, include VAT unless specified otherwise.

6. EXTRA COSTS

6.1 In addition to the rental price, the tenant also owes booking and handling costs, bed linen and tourist tax including a contribution to other levies.

7. PAYMENTS

7.1 Upon making a booking, you must make an advance payment of 30% plus the reservation and handling costs and insurance premiums. Payment of these amounts must occur within 14 days after the date of TdM Beheer BV's confirmation and invoice for the booking.
7.2 The remaining amount of the rental price must be received by TdM Beheer BV six weeks before the starting day of the stay at TdM Beheer BV, as specified in the booking's confirmation, at the latest.
7.3 Deviating from the above in case of booking between eight and four weeks before the start of your stay, the entire amount – rental price plus the costs defined in 7.1 and 7.2 – must be paid within 14 days after the date of confirmation/invoice. In case of booking within four weeks before the start of your stay, the entire amount – rental price plus the costs defined in 7.1 and 7.2 – must be paid at once. If, upon arrival at the park, it becomes apparent that the amount has not (fully) been transferred to TdM Beheer BV's bank account, you will have to pay the (remaining) amount on-site. In case of failure to pay according to the above, TdM Beheer BV may deny you use of the accommodation and/or other facility. If it turns out later that you did initiate a transfer order, but that the amount had not yet been received on TdM Beheer BV's account at the moment of your arrival, a refund of the superfluous amount will be given afterwards.
7.4 In failing to pay the amounts invoiced to you in a timely manner, you will be in arrears immediately after the expiration of the term. In this case, TdM Beheer BV will offer you the option in writing of paying the owed amount within seven days. In case this payment is not made either, TdM Beheer BV reserves the right to revoke (cancel) the agreement starting on the day on which the term has been expired for seven days, and you will be responsible for any damage incurred or to be incurred in the future by TdM Beheer BV resulting from your booking and its cancellation. TdM Beheer BV reserves the right, in any case, to charge cancellation costs per accommodation. The provisions of article 14 apply to these cases.
7.5 TdM Beheer BV reserves the right to, at any given moment, deduct any
claims charged to you of any nature from any amounts already paid by you of any nature.

8. ARRIVAL AND DEPARTURE

8.1 The rented accommodation can be occupied on the agreed upon date of arrival as specified in the booking confirmation, starting at 15:00. The accommodation must be vacated on the agreed upon date of departure as specified in the booking confirmation, before 10:00.
In case you would like to continue the agreement with TdM Beheer BV beyond the agreed upon duration and if TdM Beheer BV agrees to it, TdM Beheer BV reserves the right to allocate another accommodation/camping pitch at any time.
8.3 If the use of the accommodation and/or other facility is terminated before the agreed upon date as specified in the booking confirmation, the tenant does not have a claim to restitution of (part of) the rental price and/or costs by TdM Beheer BV. If you have purchased a cancellation insurance and if you meet the conditions set out by the insurance company, you may submit a claim based on the early termination of your stay directly to the insurance company.
In coordination with the park manager, it will be possible to arrange for early arrival or to book a late check-out at a surcharge at the reception desk.

9. REGULATIONS

9.1 All guests must abide by the rules related to the parks set out by TdM Beheer BV, as documented in documents like the park regulations. The Regulations can be found in the information folder at your accommodation.
9.2 According to local regulations, visitors are obligated to provide identification upon request during check-in. In case the guests are unable to provide identification, TdM Beheer BV may decide not to house the guests.
9.3 Each accommodation can only be occupied by the maximum number of people specified in the brochure for the concerned accommodation.
9.3 For safety reasons, you are not allowed to pitch any tents at the accommodation.
9.6 The tenant must hand over the accommodation swept and cleaned (meaning that the dishes are cleaned and stored in the cabinet, linen is taken off the beds and folded, the kitchen and refrigerator are cleaned and that the trash bag is deposited in the container).
The tenant and users are obligated to rent bed linen from TdM Beheer BV at the accommodation.
9.8 In case of violation of the rules contained in these Terms and conditions, Park Regulations and/or failure to follow directions from the staff regarding the Regulations, TdM Beheer BV reserves the right to remove you,
meaning the tenant and every other user, from the park immediately, without any restitution of the rental sum or part of it.
9.9 If park management seriously suspects that the tenant of an accommodation is acting in conflict with the law and/or public order and/or proper decency, park management is authorized to enter the accommodation.

10. PETS

10.1 Depending on the accommodation and/or camping pitch, up to one pet of the tenant or users is allowed by TdM Beheer BV. If you and/or other users wish to bring pets, you must indicate this right away during booking. In that case, TdM Beheer BV will apply a surcharge to be paid by you. TdM Beheer BV reserves the right to – without providing a reason – refuse access to pets at the park. Pets are not allowed at every accommodation, so please inquire which types do allow them during booking.
10.2 Pets are not allowed access to the water features, swimming pools, restaurants, indoor center facilities and other public venues at the park (unless specified otherwise on-site). On-site directions must be followed. The pets must not cause any nuisance to the other guests.
10.3 The dog basket must be brought along, and a flea collar for dogs/cats is mandatory.
10.4 Visitors' pets are not allowed.

11. USE OF ACCOMMODATION AND INVENTORY

1.1 The tenant and those accompanying the tenant are severally responsible for an orderly course of affairs at and around the rented accommodation and/or camping pitch or elsewhere at the park and during use of the accommodation and/or camping pitch as well as the equipment it contains.
11.2 In addition, the tenant and those accompanying the tenant are always severally responsible for any damage by broken and/or missing and/or damaged inventory and/or accommodation. Any damage must be reported to TdM Beheer BV by the tenant immediately and compensation must be paid on-site immediately, unless the tenant is able to demonstrate that the incurred damage cannot be blamed on themselves, other users or any member of their company.

12. INTERNET USE

12.1. TdM Beheer BV offers the tenant and those accompanying the tenant access to the Internet via a Wi-Fi network or via cable.
12.2 The tenant is responsible for correct use of the Internet connection as well as the necessary hardware and software, configuration, peripheral equipment and connections supporting them, as well as security measures of the computer or operating system.
12.3 TdM Beheer BV cannot be held accountable for any damage resulting from the use of the Internet or resulting from disturbances in the network.
12.4 The tenant and those accompanying them must behave as can be expected from a responsible and careful Internet user, as well as comply with the legal regulations. They will refrain from acting in ways that will cause nuisance to other Internet users or cause damage to TdM Beheer BV in the broadest sense of the word. The tenant and those accompanying the tenant will refrain from visiting Internet websites of an illegal character or those that are in conflict with the reputation of TdM Beheer BV as a provider of accommodations and/or camping pitches.
2.5 When TdM Beheer BV determines or suspects that nuisance is caused to third parties and/or other forms of Internet abuse takes place by the tenant of those accompanying the tenant, TdM Beheer BV reserves the right to block access to the Internet partly or fully, without prior
notification.
12.6 The tenant indemnifies TdM Beheer BV from any claim by third parties regarding damage which these third parties (may) make against TdM Beheer BV, insofar as these claims are based on the Internet use of the tenant or those accompanying them.

13. DEPOSIT

31.1 TdM Beheer BV may require a deposit from you upon the start of the stay. The deposit amounts to €150 per accommodation, but may be increased by TdM Beheer BV in case of groups.
13.2 The deposit serves to safeguard against damage and/or costs – in the broadest sense of the word – TdM Beheer BV might incur in case of failure on the part of the tenant or those accompanying the tenant to meet their obligations.
13.3 In case the deposit is not paid immediately, TdM Beheer BV is authorized to deny the tenant and/or other users access to and use of the accommodation and/or camping pitch.
13.4 If you fail to pay the deposit, TdM Beheer BV is also authorized to revoke (cancel) the agreement with immediate effect.
13.5 The deposit or the remaining part of it will be refunded after deducting any claims (damage to inventory/accommodation and/or other costs) by TdM Beheer BV against the tenant and/or users. Any (further) claims to damage compensation will not be made void by this restitution.
13.6 Instead of settling a deposit, you may also sign a one-off direct debit at the reception desk.

14. CANCELLATION COSTS

4.1 In case a booking is canceled, cancellation costs are owed. These amounts consist of 30% of the total costs in case of cancellation until 28 days before the day of arrival, and the total costs/agreed upon rental price in case of cancellation from the 28th day before arrival.
14.2 If you have not arrived within 24 hours after the agreed upon date without any notification, it will be considered as a cancellation.

15. FORCE MAJEURE AND ALTERATION

15.1 In case TdM Beheer BV is not able, or not able in a timely manner, to fulfill part or the entirety of the agreement due to force majeure, TdM Beheer BV will provide an alteration proposal (for another accommodation/another period, and so forth) within 14 days after becoming aware of the impossibility.
Force majeure on the part of TdM Beheer BV refers to situations where fulfillment of the agreement, either in part or in full, is hindered either temporarily or definitively due to circumstances beyond the designs of TdM Beheer BV, including the threat of war, staff strikes, blockades, fires, flooding and other disturbances or events.
15.3 You have the right to reject the alteration proposal. If you reject the alteration proposal, you must make this known within 14 days after receiving the alteration proposal. In that case, TdM Beheer BV has the right to revoke the agreement with immediate effect. You will have the right to a waiver and/or restitution of the (already paid portion of) the rental sum. TdM Beheer BV will in that case not be obligated to make compensation for any damage.

16. TERMINATION

16.1 TdM Beheer BV reserves the right to terminate the agreement with immediate effect at any moment, if personal data of you and/or other users have been provided incompletely and/or inaccurately while booking. In those cases, no restitution of the rental sum or part thereof will be made.

17. ACCOUNTABILITY

17.1 TdM Beheer BV does not accept accountability for theft, loss or damage to items or persons, regardless of their nature, during or resulting from a stay at one of our parks and/or the rent/the use of an accommodation and/or camping pitch and/or other facilities of TdM Beheer BV, unless in cases of gross fault or negligence on the part of TdM Beheer BV or one of its employees.
17.2 TdM Beheer BV is not accountable for disturbances to the service provision or faults related to services provided by third parties.
17.3 Along with the user, you will be severally responsible for all loss of and/or damage to the rented accommodation and/or camping pitch and/or other properties of TdM Beheer BV caused during their use by you and/or other users, regardless of whether or not it is caused by action or negligence on the part of you and/or third parties who are at the park with your permission.
17.4 You indemnify TdM Beheer BV of all accountability regarding claims regarding damage incurred by third parties resulting from any action or negligence by you, other users, your travel companions or third parties who are at the park with your permission.
17.5 In case of incorrect use or failing to leave the accommodation in orderly fashion, including but not limited to excessive uncleanliness, extra costs will be charged with an obligation on your part to pay them immediately.

18. COMPLAINTS

18.1 Despite the care and efforts of TdM Beheer BV, you may believe you have a justifiable complaint regarding your holiday accommodation. This complaint must initially be filed with the park manager for the park you are staying at on-site and immediately. In case the complaint is not resolved to your satisfaction, you will have 14 days from the moment of your departure from the park to file the complaint in writing to: TdM Beheer BV, Robijnstraat 30, 1812 RB Alkmaar or via email to info@tuskendemarren.nl including your reservation number, name and address details, date of the stay, park name and accommodation number. The complaint will then be handled with the utmost care. If this does not result in a satisfactory solution either, you will have until three months after departure from the park to have the complaint handled by the Dispute Commission for Recreation in The Hague, or to present the complaint to the legally competent judge. This commission's decision serves as a binding advice.

19. APPLICABLE LAW

19.1 Exclusively Dutch law applies to the agreement between you and TdM Beheer BV.

20. TRAVEL DOCUMENTS

20 You are responsible for having the valid travel documents required for your destination. TdM Beheer BV does not accept any accountability for the results of not owning the correct travel documents.

21. PRIVACY

21.1 All data you provide us with are included in a file. This file is registered with the College for the Protection of Personal Data located in The Hague. The data file is used for our guest administration. These data can also be used to provide targeted information and offers regarding our products and services, both by us and by third parties. In order to match the information and special offers to your interests to the best of our ability, we may have your data combined with data known to other companies.
21.2 Upon your request, we will correct, complete, delete or block your data, for instance when the data are factually incorrect. This may have the result that you will be unable to use (part of) our services. You have the right to request us to inform you whether or not personal data relating to you are being processed.
21.3 If you do not appreciate us sending interesting information or offers, you can let us know by sending a postcard to: TDM Beheer BV, Robijnstraat 30, 1812 RB ALKMAAR or by sending an email to info@tuskendemarren.nl.

22. GENERAL

22.1 Apparent printing and setting errors are not binding to TdM Beheer BV.
22.2 These terms and conditions render all previous publications void.
